Article 1 – Definitions

In these conditions the following definitions apply:

  • Reflection period: the period within which the consumer can exercise his right of withdrawal for online purchases;

  • Consumer: the natural person who is not acting in the exercise of a profession or business;

  • Day: calendar day;

  • Distance agreement: an agreement in which only remote communication techniques are used, such as a website or e-mail;

  • Right of withdrawal: the option of the consumer to cancel the distance contract within the cooling-off period;

  • Entrepreneur: the natural or legal person who offers products to consumers;

  • Sustainable data carrier: any means that enables the consumer or entrepreneur to store information for future use;

  • General Terms and Conditions: these terms and conditions of By Metz.

Article 3 – Applicability

  1. These general terms and conditions apply to every offer from the entrepreneur and to every agreement concluded between the entrepreneur and the consumer in the physical store as via the webshop.

  2. The rules in these terms and conditions apply to online purchases distance purchasing. The provisions apply to purchases in the physical store article 9.

  3. Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated where these conditions can be consulted or requested free of charge.

  4. If a provision in these terms and conditions is invalid or voided, the other provisions will remain in full force and effect.

  5. Situations that are not regulated in these terms and conditions will be assessed 'in the spirit' of these general terms and conditions.


Article 4 – The offer

  1. The offer contains a complete and accurate description of the products offered.

  2. Images and specifications are a true representation, but may vary slightly in color and details.

  3. Each offer contains clear information about the price, shipping costs, payment, delivery time and the right of withdrawal.

  4. Obvious errors or mistakes in the offer do not bind the entrepreneur.


Article 5 – The agreement

  1. The agreement is concluded when the consumer accepts the offer and meets the conditions set.

  2. If the agreement is concluded electronically, the entrepreneur will immediately confirm receipt of the order by e-mail.

  3. The entrepreneur takes appropriate technical and organizational measures to secure electronic data transfer.

  4. The entrepreneur can refuse an order if there are legitimate reasons to assume that the consumer will not fulfill his payment obligations.

  5. With each delivery, the consumer receives information about:

    • the visiting address for complaints,

    • the right of withdrawal,

    • warranty and service conditions.


Article 6 – Right of withdrawal (Online purchases)

  1. The consumer has the right to place an order via the webshop within 14 days of receipt without giving reasons.

  2. The cooling-off period starts on the day after the consumer has received the product.

  3. During the cooling-off period, the consumer will handle the product and packaging with care.

  4. The consumer reports the withdrawal via e-mail (info@bymetz.nl) or via it return portal:

  5. After registration, the consumer still has: 14 days the time to return the products.

  6. Products must be returned complete, unused, in their original condition and, if possible, in their original packaging, including tags, tags, price tags and accessories.

  7. If the product is damaged or the packaging is damaged more than is necessary to try the product, we can pass on this depreciation of the product to you. So handle the product with care and ensure that it is properly packaged when returned.


Article 7 – Returns and costs in case of withdrawal

  1. You can easily return via the returns portal:

    Enter the order number and zip code and hand in the package at a PostNL or DHL point.

  2. The costs for returning via the portal are: €6,95 and will be settled upon reimbursement.

  3. If the order is not collected from a service point and is returned, return costs + administration costs (€9.95) deducted from the refund.

  4. If the consumer chooses to return on his own initiative (i.e. outside the returns portal), the shipping costs are entirely at his own expense.

  5. The refund of the purchase amount (and shipping costs if applicable) will take place within 14 days after receipt of the return shipment, via the original payment method.

  6. By Metz is not responsible for damage or loss of return shipments, even when using the returns portal.

  7. It is also possible to place an online order free to return or exchange in store from By Metz during opening hours.
    This can also be indicated in advance via the returns portal.


Article 8 – Exclusion of right of withdrawal

The right of withdrawal does not apply to products that:

  • are manufactured according to consumer specifications;

  • be personal in nature;

  • cannot be returned for hygienic reasons and the seal has been broken;

  • Due to their nature they cannot be returned.


Article 9 – Purchases in the store

  1. One applies in the physical store different return policy then online.

  2. Cash refund: Customers can enter for purchases without a discount 7 days will receive a refund of the purchase price, provided the item is unworn, undamaged and provided with original labels.

  3. Exchange right: one applies to purchases in the store exchange period of 30 days, also for discounted items.

  4. No refunds will be given for discounted items unless there is a manufacturing defect.


Article 10 – The price

  1. All prices include VAT and are subject to printing and typographical errors.

  2. Obvious errors in the price do not bind the entrepreneur.

  3. Price increases after conclusion of the agreement are only permitted if this results from legal provisions.


Article 11 – Conformity and warranty

  1. The entrepreneur guarantees that the products comply with the agreement and the reasonable requirements of reliability.

  2. Any defects or incorrectly delivered products must be reported within 14 days of delivery info@bymetz.nl.

  3. The legal warranty remains applicable.

  4. Damage caused by misuse, wear or careless handling is not covered by the warranty.


Article 12 – Delivery and execution

  1. Delivery takes place at the address specified by the consumer.

  2. Orders will be delivered as soon as possible, but no later than within 30 days, unless otherwise agreed.

  3. If delivery is delayed, the consumer will be informed in a timely manner and he can terminate the agreement free of charge.

  4. The risk of damage passes to the consumer upon receipt of the product.


Article 13 – Payment

  1. Payment takes place via the payment methods offered in the webshop.

  2. For cash payments in the store, immediate payment applies upon purchase.

  3. In the event of non-payment, the entrepreneur is entitled to claim statutory interest and collection costs.


Article 14 – Contact and communication (WhatsApp)

  1. By providing a telephone number when placing an order the consumer agrees with receiving messages via WhatsApp about his order (such as confirmations, delivery information or questions).

  2. By Metz uses WhatsApp exclusively for customer communication regarding orders and never for unsolicited advertising or promotion without permission.


Article 15 – Complaints procedure

  1. Complaints can be submitted via info@bymetz.nl or in writing at the store address.

  2. Complaints are received 14 days treated.

  3. If the complaint is not resolved by mutual agreement, the consumer can contact: WebwinkelKeur (www.webwinkelkeur.nl) for mediation.


Article 16 – Disputes

  1. Agreements between By Metz and the consumer are exclusive Dutch law applicable.

  2. It Vienna Sales Convention does not apply.


Article 17 – Additional or deviating provisions

Additional or deviating provisions from these conditions may not be to the detriment of the consumer and must be recorded in writing.
