Article 1 – Definitions

In these terms and conditions the following terms shall have the following meanings:

  • Reflection period: the period within which the consumer can exercise his right of withdrawal for online purchases;

  • Consumer: the natural person who does not act in the exercise of a profession or business;

  • Day: calendar day;

  • Distance contract: a contract concluded exclusively using distance communication techniques, such as a website or e-mail;

  • Right of withdrawal: the option for the consumer to cancel the distance contract within the cooling-off period;

  • Entrepreneur: the natural or legal person who offers products to consumers;

  • Durable medium: any instrument that enables the consumer or entrepreneur to store information for future use;

  • General Terms and Conditions: these terms and conditions of By Metz.

Article 3 – Applicability

  1. These general terms and conditions apply to every offer made by the entrepreneur and to every agreement concluded between the entrepreneur and the consumer, both in the physical store and via the webshop .

  2. The rules in these terms and conditions regarding distance selling apply to online purchases. For purchases in a physical store, the provisions of Article 9 apply.

  3. Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, the consumer will be informed of where these terms and conditions can be consulted or requested free of charge.

  4. If any provision of these terms and conditions is invalid or voidable, the remaining provisions will remain in full force and effect.

  5. Situations not covered by these terms and conditions will be assessed 'in the spirit' of these general terms and conditions.


Article 4 – The offer

  1. The offer contains a complete and accurate description of the products offered.

  2. Images and specifications are a true representation, but may vary slightly in color and detail.

  3. Each offer contains clear information about price, shipping costs, payment, delivery time and the right of withdrawal.

  4. Obvious errors or mistakes in the offer do not bind the entrepreneur.


Article 5 – The Agreement

  1. The agreement is concluded when the consumer accepts the offer and meets the conditions set.

  2. If the agreement is concluded electronically, the entrepreneur will immediately confirm receipt of the order by e-mail.

  3. The entrepreneur shall take appropriate technical and organizational measures to secure electronic data transfer.

  4. The entrepreneur may refuse an order if there are reasonable grounds to assume that the consumer will not meet his payment obligations.

  5. With every delivery the consumer receives information about:

    • the visiting address for complaints,

    • the right of withdrawal,

    • warranty and service conditions.


Article 6 – Right of withdrawal (Online purchases)

  1. The consumer has the right to cancel an order placed through the webshop within 14 days of receipt without giving any reason.

  2. The cooling-off period starts on the day after the consumer receives the product.

  3. During the cooling-off period, the consumer will handle the product and packaging with care.

  4. The consumer reports the revocation by e-mail ( info@bymetz.nl ) or via the returns portal :

  5. After registration, the consumer has 14 days to return the products.

  6. Products must be returned complete, unused, in their original condition and, if possible, in their original packaging, including labels, tags, price tags and accessories.

  7. If the product is damaged or the packaging is damaged beyond what's necessary to try it out, we may charge you for the reduction in value. Therefore, please handle the product with care and ensure it is properly packaged when returning it.


Article 7 – Returns and costs in case of cancellation

  1. Returns can be easily made via the returns portal:

    Enter the order number and postal code and deliver the package to a PostNL or DHL point.

  2. The costs for returning via the portal are €6.95 and will be deducted from the refund.

  3. If the order is not collected at a service point and is returned, return costs + administration costs (€9.95) will be deducted from the refund.

  4. If the consumer chooses to return the product on their own initiative (i.e. outside the returns portal), the shipping costs are entirely at their own expense.

  5. The refund of the purchase price (and shipping costs if applicable) will be made within 14 days of receipt of the return shipment , via the original payment method.

  6. By Metz is not responsible for damage or loss of returns, even when using the returns portal.

  7. It is also possible to return or exchange an online order free of charge in the By Metz store during opening hours.
    This can also be indicated in advance via the returns portal.


Article 8 – Exclusion of the right of withdrawal

The right of withdrawal does not apply to products that:

  • are manufactured according to consumer specifications;

  • be personal in nature;

  • cannot be returned for hygienic reasons and the seal has been broken;

  • cannot be returned due to their nature.


Article 9 – Purchases in the store

  1. A different return policy applies in the physical store than online.

  2. Cash refund: For purchases without a discount, the customer can get a refund within 7 days , provided the item is unworn, undamaged and has the original tags attached.

  3. Right of exchange: for purchases made in the store, there is a 30-day exchange period , even for discounted items.

  4. No refunds will be given for discounted items unless there is a manufacturing defect.


Article 10 – The price

  1. All prices include VAT and are subject to printing and typographical errors.

  2. Obvious errors in the price do not bind the entrepreneur.

  3. Price increases after the agreement has been concluded are only permitted if this results from statutory provisions.


Article 11 – Conformity and warranty

  1. The entrepreneur guarantees that the products comply with the agreement and the reasonable requirements of soundness.

  2. Any defects or incorrectly delivered products must be reported within 14 days of delivery via info@bymetz.nl .

  3. The statutory warranty remains applicable.

  4. Damage caused by misuse, wear and tear or careless handling is not covered by the warranty.


Article 12 – Delivery and execution

  1. Delivery will take place at the address specified by the consumer.

  2. Orders will be delivered as soon as possible, at the latest within 30 days, unless otherwise agreed.

  3. If delivery is delayed, the consumer will be notified in a timely manner and can cancel the agreement free of charge.

  4. The risk of damage passes to the consumer upon receipt of the product.


Article 13 – Payment

  1. Payment takes place via the payment methods offered in the webshop.

  2. When paying in cash at the store, immediate payment is required upon purchase.

  3. In the event of non-payment, the entrepreneur is entitled to claim statutory interest and collection costs.


Article 14 – Contact and communication (WhatsApp)

  1. By providing a telephone number with an order, the consumer agrees to receive messages via WhatsApp about their order (such as confirmations, delivery information or questions).

  2. By Metz uses WhatsApp exclusively for customer communication regarding orders and never for unsolicited advertising or promotion without permission.


Article 15 – Complaints procedure

  1. Complaints can be submitted via info@bymetz.nl or in writing at the store address.

  2. Complaints will be handled within 14 days .

  3. If the complaint is not resolved by mutual agreement, the consumer can contact WebwinkelKeur ( www.webwinkelkeur.nl ) for mediation.


Article 16 – Disputes

  1. Agreements between By Metz and the consumer are exclusively governed by Dutch law .

  2. The Vienna Sales Convention does not apply.


Article 17 – Additional or deviating provisions

Additional or deviating provisions from these conditions may not be to the detriment of the consumer and must be recorded in writing.
